BY PURCHASING/DOWNLOADING PTBOOTH SOFTWARE YOU AGREE TO BE BOUND BY THE TERMS AND CONDITIONS BELOW.
THESE TERMS AND CONDITIONS ARE SUBJECT TO CHANGE WITHOUT NOTICE, FROM TIME TO TIME IN OUR SOLE DISCRETION.

IF YOU DO NOT AGREE WITH THE TERMS AND CONDITIONS STATED ON THIS PAGE, PLEASE DO NOT PURCHASE/DOWNLOAD PTBOOTH SOFTWARE.
Effective January 1 2017:

To avoid any potential mistakes, complications, misrepresentations, misunderstandings, or any disputes, we have implemented the following rules that apply to all transactions for the PTBooth A1 PLUS and PTBooth A1 PRO Software.

1. WE REQUIRE THAT YOU TEST THE FREE DEMO VERSION OF THE 2017 PTBOOTH A1 PLUS and/or PTBOOTH A1 PRO BEFORE MAKING A PURCHASE
- Using the DEMO version you will be able to TEST AND EVALUATE THE 2017 PTBOOTH A1 PLUS and/or PTBOOTH A1 PRO SOFTWARE FEATURES, PERFORMANCE, AND YOUR DEVICE’S COMPATIBILITY.

2. ALL PURCHASE REQUESTS REQUIRE COMMUNICATION WITH THE CUSTOMERS IN THE FORM OF QUESTIONS/ANSWERS.
Your answers will help us to improve PTBooth software and will serve as the official statements in communication between the involved parties.

3. Your NAME AND EMAIL that you used to request the FREE 2017 PTBooth A1 PLUS DEMO and/or PTBooth A1 PRO DEMO must be the same NAME AND EMAIL used to make your payment for the Full version of 2017 PTBooth A1 PLUS.
(For example:
- Demo request made: John john@domain.com
- Purchase request made: John john@domain.com
- Payment made: John john@domain.com)
This is necessary to assure that the person who tested the FREE 2017 PTBooth A1 PLUS DEMO and/or PTBooth A1 PRO DEMO is the same customer who made the purchase decision of the Full version of 2017 PTBooth A1 PLUS and/or PTBooth A1 PRO based on a successful experience with the Demo version.

THERE ARE NO EXCEPTIONS!
WE RESERVE THE RIGHT TO DECLINE ANY REQUESTS FROM CUSTOMERS THAT FAILED TO FOLLOW THE RULES AND DO NOT AGREE WITH OUR TERMS AND CONDITIONS.

END-USER LICENSE AGREEMENT FOR "PTBOOTH"
Custom Photo Booth Software

IMPORTANT PLEASE READ THE TERMS AND CONDITIONS OF THIS LICENSE AGREEMENT CAREFULLY BEFORE CONTINUING WITH THIS PROGRAM DOWNLOAD AND INSTALL:
Promotions Technologies Inc.(PT BOOTH Software Developer) End-User License Agreement ("EULA") is a legal agreement between you (either an individual or a single entity) ("BUYER") and Promotions Technologies Inc. for the PT BOOTH Custom Photo Booth Software product(s) identified above which may include associated software components, media, printed materials, and "online" or electronic documentation ("SOFTWARE PRODUCT"). By installing, copying, or otherwise using the SOFTWARE PRODUCT, you agree to be bound by the terms of this EULA. This license agreement represents the entire agreement concerning the program between you and Promotions Technologies inc., (referred to as "licenser"), and it supersedes any prior proposal, representation, or understanding between the parties. If you do not agree to the terms of this EULA, do not install or use the SOFTWARE PRODUCT.

The SOFTWARE PRODUCT is protected by copyright laws and international copyright treaties, as well as other intellectual property laws and treaties. The SOFTWARE PRODUCT is licensed, not sold.

1. GRANT OF LICENSE.
The SOFTWARE PRODUCT is licensed as follows:

(a) Installation and Use.
You agree your license is for a "single user" SOFTWARE PRODUCT. You agree this is not a "multi-user" license. You may install ONE single copy of the SOFTWARE PRODUCT on a single computer or workstation ("COMPUTER"). You shall not install or use the "single user" SOFTWARE PRODUCT on a second or multiple computers or workstations. You are GRANTED PERMISSION TO CHANGE COMPUTERS ONE TIME ONLY under your "single user" license. To be granted a one-time change of computers, you agree to contact Promotions Technologies prior to removing the SOFTWARE PRODUCT. Promotions technologies shall then grant you a new license for the "one-time" change of computer. The COMPUTER with the installed SOFTWARE PRODUCT is identified by a unique set of identification numbers. The license is based on a single COMPUTER identification number. Only one license will be issued per purchase per COMPUTER. Any requests for an additional license for a new or different COMPUTER beyond one-time change of computers will require a new license purchase. The license is also known as an activation code. Promotions Technologies Inc. grants you the right to install and use copy of the SOFTWARE PRODUCT on your computer running a validly licensed copy of the operating system for which the SOFTWARE PRODUCT was designed [Windows 10, Windows 8, Windows 7]. Due to territory guidelines Promotions Technologies Inc. forbids you from commercial use of the SOFTWARE PRODUCT within 100 miles radius of the Dallas/Fort Worth Metroplex, (including Dallas, Texas Fort Worth, Texas and surrounding areas).

(b) Backup Copies.
You may make copies of the SOFTWARE PRODUCT as may be necessary for backup and archival purposes.

2. DESCRIPTION OF OTHER RIGHTS AND LIMITATIONS.
(a) Maintenance of Copyright Notices.
You must not remove or alter any copyright notices on any and all copies of the SOFTWARE PRODUCT.

(b) Distribution.
YOU MAY NOT DISTRIBUTE registered copies of the SOFTWARE PRODUCT to third parties. Evaluation versions available for download from Promotions Technologies Inc.'s websites.

(c) Prohibition on Reverse Engineering, Decompilation, and Disassembly.
YOU MAY NOT REVERSE ENGINEER, DECOMPILE, OR DISASSEMBLE the SOFTWARE PRODUCT, except and only to the extent that such activity is expressly permitted by applicable law notwithstanding this limitation.

(d) Rental.
You may not rent, lease, or lend the SOFTWARE PRODUCT.

(e) Support Services.
Promotions Technologies Inc. may provide you with support services related to the SOFTWARE PRODUCT ("Support Services"). Any supplemental software code provided to you as part of the Support Services shall be considered part of the SOFTWARE PRODUCT and subject to the terms and conditions of this EULA.

(f) Compliance with Applicable Laws.
You must comply with all applicable laws regarding use of the SOFTWARE PRODUCT.

3. TERMINATION
Without prejudice to any other rights, Promotions Technologies Inc. may terminate this EULA if you fail to comply with the terms and conditions of this EULA. In such event, you must destroy all copies of the SOFTWARE PRODUCT in your possession.

4. COPYRIGHT
All title, including but not limited to copyrights, in and to the SOFTWARE PRODUCT and any copies thereof are owned by Promotions Technologies Inc. or its suppliers. All title and intellectual property rights in and to the content which may be accessed through use of the SOFTWARE PRODUCT is the property of the respective content owner and may be protected by applicable copyright or other intellectual property laws and treaties. This EULA grants you no rights to use such content. All rights not expressly granted are reserved by Promotions Technologies Inc..

5. NO WARRANTIES
Promotions Technologies Inc. expressly disclaims any warranty for the SOFTWARE PRODUCT. The SOFTWARE PRODUCT is provided 'AS IS' without any express or implied warranty of any kind, including but not limited to any warranties of merchantability, noninfringement, or fitness of a particular purpose. Promotions Technologies Inc. does not warrant or assume responsibility for the accuracy or completeness of any information, text, graphics, links or other items contained within the SOFTWARE PRODUCT. Promotions Technologies Inc. makes no warranties respecting any harm that may be caused by the transmission of a computer virus, worm, time bomb, logic bomb, or other such computer program. Promotions Technologies Inc. further expressly disclaims any warranty or representation to Authorized Users or to any third party. BUYER ACKNOWLEDGES THAT THE SOFTWARE MAY NOT BE FREE FROM DEFECTS AND MAY NOT SATISFY ALL OF BUYER'S NEEDS.

6. LIMITATION OF LIABILITY
In no event shall Promotions Technologies Inc. be liable for any damages (including, without limitation, lost profits, business interruption, or lost information) rising out of 'Authorized Users' use of or inability to use the SOFTWARE PRODUCT, even if Promotions Technologies Inc. has been advised of the possibility of such damages. In no event will Promotions Technologies Inc. be liable for loss of data or for indirect, special, incidental, consequential (including lost profit), or other damages based in contract, tort or otherwise. Promotions Technologies Inc. shall have no liability with respect to the content of the SOFTWARE PRODUCT or any part thereof, including but not limited to errors or omissions contained therein, libel, infringements of rights of publicity, privacy, trademark rights, business interruption, personal injury, loss of privacy, moral rights or the disclosure of confidential information.
